Terms of Service

Last updated 2 November 2026

The short version:

  • Your subscription lets you use XMKT on up to 2 of your own Macs.
  • You can cancel at any time and keep access until the end of the month you've paid for.
  • XMKT shows market data; it is not financial advice and it can't trade for you.
  • Data comes from third parties and can be late or wrong.

The full terms below are what apply.

1. Who we are and what these terms cover

These terms are between you and XMKT ("we", "us"), the maker of the XMKT Terminal desktop app ("XMKT" or "the app") and the xmkt.org website. They cover your subscription and your use of the app. By subscribing, or by downloading or using the app, you agree to them. If you don't agree, please don't use XMKT.

You must be old enough to enter into a binding contract where you live to subscribe.

2. Buying a subscription

XMKT is sold through Polar (polar.sh), which acts as our reseller and merchant of record. Polar takes your payment, issues your receipt and handles VAT and sales tax. Polar's own terms of sale also apply to your purchase.

Your subscription is billed monthly, in advance, at the price shown at checkout. It renews automatically each month until you cancel. If we change the price, we'll tell you by email at least 30 days before the new price applies, and you can cancel before then.

3. Cancelling

You can cancel at any time from Polar's customer portal (linked from your receipt email). When you cancel, you won't be charged again, and XMKT keeps working until the end of the period you've already paid for. Refunds are covered in our refund policy.

4. Your licence

While your subscription is active, we give you a personal, non-exclusive, non-transferable licence to install and use XMKT on up to 2 Macs that you own or control. Your licence key activates the app on each Mac. You can move it to another Mac by deactivating an old one, either in the app (API KEY → Deactivate this Mac) or in Polar's customer portal.

The app checks your licence key with Polar when it opens and every few hours while it's running. If your subscription ends or your key is revoked, the app locks. If you're offline, it keeps working for up to 7 days from the last successful check.

5. Fair use

You agree not to:

We may suspend or end your licence if you break these rules. If we do, we'll tell you why where we reasonably can.

6. Your own API keys and accounts

XMKT uses your own Finnhub API key for live US market data and, if you choose, your own Interactive Brokers connection through IB Gateway. Those accounts are between you and those providers, and their terms apply to your use of them. Finnhub's free plan is enough for XMKT. Any paid data subscriptions you buy from them are separate from, and not included in, your XMKT subscription.

Your API keys are stored only on your Mac and sent only to the provider they belong to. The Interactive Brokers connection is read-only: XMKT cannot place, change or cancel orders.

7. Market data and news

XMKT displays information from third parties, including Finnhub, Coinbase, public index and futures quotes, official statistics publishers, SEC EDGAR and news publishers. We don't control these sources. Data may be delayed (many indices and futures by about 15 minutes), incomplete, interrupted or wrong, and a source may stop being available. News links take you to the publishers' own sites.

We'll try to keep XMKT working when sources change, but we can't promise that every source will stay available.

8. Not financial advice

XMKT is a tool for viewing market information. Nothing in the app or on our website is investment, financial, tax or legal advice, or a recommendation to buy or sell anything. You're responsible for your own investment decisions. Before acting on any data, check it with the original source or a qualified adviser.

9. Updates and changes to the app

While you're subscribed, you'll have access to new versions of XMKT. We may add, change or remove features over time. If we remove a major feature you're paying for, we'll let you know and you can cancel.

10. Our responsibility to you

XMKT is provided "as is" and "as available". To the fullest extent the law allows, we don't give any warranty that it will be uninterrupted, error-free or fit for a particular purpose, beyond what the law says we must.

To the fullest extent the law allows, we're not liable for any trading or investment losses, loss of profits, or losses caused by inaccurate or delayed data. Our total liability to you for anything related to XMKT is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud. If you're a consumer, nothing here affects your statutory rights.

11. Ending these terms

These terms last while you have a subscription or use the app. They end when your subscription ends, or earlier if we end your licence under section 5. Sections 7, 8 and 10 continue to apply after that.

12. Changes to these terms

We may update these terms. If a change matters to you, we'll email you before it takes effect. If you keep using XMKT after that, the new terms apply; if you don't agree, you can cancel.

13. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live elsewhere in the UK or in the EU, you can also rely on the mandatory consumer laws of where you live and bring a claim in your local courts.
